This Privacy Policy is a legal contract between you and PMD, LLC (referred to herein as “Puppet Party” Puppet Party Mobile, “us” or “we”) and sets forth certain privacy terms and conditions with respect to your use of our services.
This Privacy Policy applies to PMD, LLC’s Puppet Party Mobile Service the “Service” which includes all Puppet Party mobile applications, websites, products, features, applications, services, technologies and software.
BY USING THE SERVICE, YOU UNCONDITIONALLY AGREE TO THIS PRIVACY POLICY AND OUR SEPARATE TERMS OF SERVICE AGREEMENT WHICH INCLUDES ABRITRATION TERMS AND A CLASS ACTION WAIVER. If you are outside of the United States and access the Service or submit your Personal Data to us, please be advised that U.S. law may not offer the same privacy protections as the law of your jurisdiction. If you use the Service or contact us from outside of the United States, please be advised that any information you provide to us or that we automatically collect will be processed in accordance with this Privacy Policy and U.S. laws.
Collection of your Personal Information
In order to better provide you with products and services offered through the Service, we may collect personally identifiable information, such as but not limited to your:

- Mailing Address
- E-mail Address
- Phone Number
- Birthdate and/or Age
- Your IP Address
- Your Uploaded and Created Content
We may also collect billing and credit card information. This information is used to complete purchase transactions.
We may also collect and utilize other data either directly or via third-parties including but not limited to: your audio recordings, text input, file uploads, your usage of features, functions and pages accessed on the Service, personal interests, location, IP address, language, gender. User account information may also be collected and potentially displayed in order to enrich the user experience and facilitate user interaction through the Service and in email communications. Information collected or received by us, solely to the extent any such information can be used to identify an individual person and is considered individually identifiable information within the meaning of the Federal Trade Commission’s Online Privacy Protection Rule found at 16 CFR 312.2, is referred to in this Privacy Policy as “Personal Data.” Each user hereby agrees that all information you provide, including but not limited to age, shall be truthful and correct.
You understand that the Service allows, among other things, the ability for users to upload “user provided content” that may contain personal information or personal data that would be collected, utilized, stored and included in the Service’s output (including audio and video outputs). ACCORDINGLY, BY SUBMITTING USER PROVIDED CONTENT OR MATERIALS THROUGH THE SERVICE, YOU HEREBY WAIVE ANY AND ALL PRIVACY EXPECTATIONS (INCLUDING THE PRIVACY EXPECTATIONS OF ANY OTHER INDIVIDUAL WHOSE PERSONAL INFORMATION IS INCLUDED IN YOUR SUBMITTED CONTENT). IF YOU DO NOT CONSENT TO HAVE PERSONAL CONTENT VIEWABLE, HEARD OR OTHERWISE ACCESSIBLE BY OTHERS, YOU SHOULD NOT SUBMIT THE MATERIALS OR ANY OTHER CONTENT TO OR THROUGH THE SERVICE. If you directly disclose personally identifiable information or personally sensitive data through the Service, this information may be collected and used by others.
You may be required to provide certain personal information to us when you elect to use certain products or services available through the Service. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us as well as for marketing communications. We also may gather additional personal or non-personal information in the future.

We collect and use your personal information to operate the Service. We may also use your personally identifiable information to inform you of other products or services available from us and our affiliates.
Sharing Information with Third Parties
We do not sell, rent or lease our customer lists to third parties.
We may share your personal data with trusted partners to help perform statistical analysis, process payment transactions, send you email or postal mail, provide account access, provide customer support, or arrange for delivery of content created by you or us. All such third parties are prohibited from using your personal information except to provide these services to us, and they are required to maintain the confidentiality of your information.

Tracking User Behavior
We, and our third-party partners, may keep track of your activities on our website(s), mobile apps or other means in order to determine what services are the most popular and how our Services are functioning. We may also track specific data concerning your puppet selections and other video creation activities. This data is used to help us manage and optimize our Service, deliver customized content and targeted advertising.
Automatically Collected Information
Information about your computer, phone or other access hardware and software may be automatically collected by us. This information can include: your IP address, browser type, device type, operating information, domain names, access times and referring website addresses. This information is used for the operation of the Service, to maintain and enhance the quality of the Service, and to provide general statistics regarding use of the Service.
Use of Cookies and Web Beacons
The Service may use "cookies" to help personalize your experience. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you. We may use Web Beacons to collect and store information about your usage of the Service. Web Beacons may also be used in email messages and advertisements.

The Service may contain links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and/or mobile apps and to read the privacy statements of any other site that collects personally identifiable information.
Security of your Personal Information
We attempt to secure your personal information from unauthorized access, use, or disclosure.
When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.
We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. However, we do not guarantee that our efforts will completely protect user account information. Unfortunately, no data service or transmission over the Internet, connected to the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we attempt to protect your personal information, you acknowledge that: (a) there are security and privacy limitations which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us or held by us through this Service cannot be guaranteed to be 100% secure.
We urge you to keep your username, password, and other account access information in a safe place and not to divulge it to anyone.
Data Retention
We keep your personal data only as long as necessary to provide you with the Service and for legitimate and essential business purposes, such as maintaining the performance of the Service, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes. We keep some of your personal data for as long as you are a user of the Service.
If you send a request to events@puppetpartyapp.com, we will delete or anonymize your personal data held by us so that it no longer identifies you, unless, we are legally allowed or required to maintain certain personal data, including situations such as the following:
If there is an unresolved issue relating to your account, such as an outstanding amount due on your account or an unresolved claim or dispute, we will retain the necessary personal data until the issue is resolved;
Where we are required to retain the personal data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or,
Where necessary for our legitimate business interests such as Service operation, fraud prevention or to maintain the security of our users.
Children Under Seventeen (17)
We do not knowingly collect personally identifiable information from children under the age of seventeen (17). If you are under the age of seventeen (17), you may not create an account on the Service or use the Service in any manner. We do not knowingly allow the creation of user accounts, or collect, either online or offline, personal information from or by persons under the age of seventeen (17).
If your child is younger than seventeen (17) and created an account on the Service, you can show them how to delete their account under in the Settings section of the mobile app.
If you'd like to report an account belonging to a child under seventeen (17) or if you believe someone is impersonating a child who's under seventeen (17), please email us at events@puppetpartyapp.com Please provide the child’s user name, the full name of the child and their date of birth. We will verify the child’s age prior to deleting the account. If the child’s age can’t be verified, then we may not be able to action on the account.
E-mail Communications
From time to time, we may contact you via email for the purpose of providing renewal reminders, announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Service, we may receive a notification when you open an email from us or click on a link therein.
If you would like to stop receiving marketing or promotional communications via email from us, you may opt out of such communications by using the unsubscribe link contained in the email.
If you would like to stop receiving administration, account-related emails from us, your only option is to deactivate your account and stop using the Service.
External Data Storage Sites And Other Third Parties
We may transmit and store your data on servers provided by third party hosting and services vendors with whom we have contracted. We may also contract with other third parties to assist us in providing the Services.
Changes to this Privacy Policy
We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account or by placing a prominent notice on our Service. Your continued use of the Service after such modification(s) will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
